When renting a property to a tenant under an assured shorthold tenancy a landlord will frequently take a deposit. The law on how a landlord deals with tenancy deposits has changed and become more onerous to a landlord since the introduction of the Housing Act 2004.
There is some confusion and uncertainty over when and in what circumstances deposits must be registered or reregistered. This has resulted in much case law to clarify the position for both parties.
